Terms of Service

General

  1. The online website of "Meshek Piltzovitch" is an internet site through which orders can be placed for products from Meshek Piltzovitch (hereinafter: "the Website"). The Website is operated and managed by Meshek Piltzovitch Ltd. Company No. 51649887, from Moshav HaYogev, Jezreel Valley 1923200 (hereinafter: "the Store"), as part of its efforts to promote and improve the service provided to its customers.
  2. Any person or company performing any action on the Website, including a person making a purchase (hereinafter: "the Customer"), declares by performing the action on the Website that they have read these terms, agree to their provisions, and that the purchase process on the Website will be subject to the conditions detailed in these terms, and that they and/or anyone on their behalf will have no claim or lawsuit against the Store and/or anyone on its behalf and/or any of its managers and/or any of its employees.
  3. The service provided through the Website is available in certain areas only within the delivery zones of an external courier company (hereinafter: "Service Area").
  4. It is clarified that despite the above, the Store has the exclusive right to change the Service Area from time to time without prior notice.
  5. Delivery of products purchased through the Website or by phone order is possible only when the requested address is within the Service Area, and there is no technical or other obstacle preventing product delivery.
  6. The Store reserves the right to change these terms from time to time, at its sole discretion, without the need for any prior notice or warning. The Customer will have no claims against the Store for such changes. The change will take effect from the first publication of the updated terms on the Website, and any action performed on the Website after such publication will be subject to the updated terms.
  7. The Store, at its sole discretion, may change and/or discontinue the Website's operation at any time, without any prior notice or warning.
  8. The Store, at its sole discretion, may change and/or add and/or remove content from the Website without any prior notice or warning.
  9. The Website content and these terms are written in masculine form for convenience only. Reference is to both genders equally. Wherever the Website content and/or these terms are written in singular form, the reference is to singular and/or plural as applicable.
  10. The provisions of these terms will also apply if the Customer chooses to place an order by phone or other means.

Products

  1. In these terms, "Products" means food products sold from time to time in the Store and displayed on the Website.
  2. The Store is not obligated in any way to maintain any variety of products and may change at any time any of the products displayed in the product list on the Website, replace any of the products on the list, or remove any of the products from said list.
  3. The manner of displaying products on the Website will be determined by the Store from time to time at its sole discretion. It is clarified that product images displayed on the Website are for illustration purposes only and do not bind the Store in any way.
  4. Allergens - Do not rely on the details appearing in the product ingredients as displayed on the Website, if any. Always read the information on the product before use.

Prices

  1. Product prices published on the Website are the prices as last updated before the Customer's visit to the Website and/or at the time of entering and confirming the order on the Website, whichever is later.
  2. It is hereby clarified that the Store may update product prices on the Website from time to time at its sole discretion.
  3. Regarding sales on the "Meshek Piltzovitch" online website, whether or not products bear a printed price tag, prices of products sold on the "Meshek Piltzovitch" online website do not necessarily match the prices of products sold in the physical store from which products are collected for delivery to the Customer. In any case, the price stated on the invoice, which is the online website price, will be binding, not the price appearing (if any) on any price tag on the product. Customers wishing to purchase products by phone may request that product prices be read to them. Product prices are also listed on the Website and can be checked before ordering. The binding prices for completing the purchase, according to which the purchase amount will be charged, are the prices in the order as they appear on the Website as stated above, and will be valid for 24 hours.
  4. Product prices marked as discounted, on sale, or with other benefits will be valid for 24 hours from the time of placing the order.
  5. Products displayed for sale at promotional prices and marked with a discount, sale, or other benefit indication will be supplied at the promotional price, subject to the order being confirmed with the Store on the day the order was placed on the Website.
  6. Product prices include Value Added Tax (VAT).

Placing Orders

  1. A prerequisite for placing an order through the Website is registration and filling in all requested Customer details.
  2. A Customer placing an order must provide accurate details that belong to them alone and may not place orders on behalf of any third party. Providing complete, accurate, and correct details is a prerequisite for completing the purchase. To ensure the order is processed quickly, efficiently, and without issues, all details must be provided accurately. If incorrect details are provided when placing the order, the Store cannot guarantee that products will reach their destination.
  3. The details as entered on the online registration page on the Website will constitute conclusive and final evidence of the accuracy of the Customer's details.
  4. Entering false information is a criminal offense, and those who do so may face criminal and civil legal proceedings.
  5. At the end of the order process, a page will be received displaying the order details, which will serve as confirmation of the order submission.
  6. The Store reserves the right to cancel and/or not grant any person the right to place orders on the Website without needing to provide any reasons for such decision.
  7. Payment on the Website will be made using a valid Israeli credit card belonging to the ordering Customer whose identity details match the information entered into the system.
  8. Credit terms will be in accordance with the terms customary in the Store at the time of purchase.
  9. The Store does not make any use of payment method details provided by the Customer and does not store them in any database, nor does it transfer them to any third party, except for processing payment only to complete the purchase as detailed in these terms.

Delivery and Shipping Fees

  1. In addition to product prices, the Customer will be charged shipping fees as published on the Website or as communicated to the Customer by a Store representative at the time of payment.
  2. Products included in the order will be supplied by the Store, as available in the Store's inventory at the time of payment.
  3. It is clarified that product delivery for orders received will be subject to transaction and payment method approval by the credit card company.
  4. It is clarified that orders are packed every Sunday and shipments go out once a week with an external courier company. The Store will offer delivery dates according to its delivery capacity at that time, at its sole discretion, and subject to the external courier company's policy.
  5. Failure by the Store to meet the agreed delivery date, for any reason, will not exempt the Customer from payment for an order actually delivered to them.
  6. The Store will endeavor to supply all products in the order; however, not all products will always be available for delivery within a reasonable time. Therefore, the Store does not commit to supplying all products in the order whether or not they are indicated as in stock, and the Customer will have no claims against the Store for non-delivery of any product from the order. The Store will supply the Customer only with products available in the Store's inventory at the time of payment.
  7. If the Customer or their representative is not present at the time of delivery at the requested delivery address, the products will be returned to the Store and an alternative delivery date will be arranged at the Customer's responsibility, meaning the Customer will contact the Store to arrange a new delivery date. In such case, the Customer will be charged return shipping fees for returning the products to the Store and additional shipping fees for delivery on a new date. It is clarified that failure by the Customer to arrange a new order date will not exempt them from payment for the order they placed.
  8. It is clarified that if the Customer is not at the address and approves by phone to leave the products near their door or at another location near their address, the Customer hereby agrees and confirms that responsibility for the products will be theirs alone and they will have no claim and/or lawsuit, including for theft and/or spoilage regarding products left as described.
  9. Ordered products will be packed in plastic bags and/or any other packaging, at the Store's discretion, and the Customer will have no claim and/or lawsuit regarding this.

Product Returns

  1. The Customer must check the shipment contents upon receipt and compare them to both the order and the invoice provided at delivery.
  2. A Customer claiming product non-conformity following the above check or in any other case of dissatisfaction regarding the products supplied, must notify the Store within 48 hours of the delivery date. Failure to provide notice within said timeframe will constitute the Customer's waiver of any claim and/or lawsuit regarding non-conformity and/or dissatisfaction.
  3. A Store representative will examine the Customer's claim and if necessary, at the Store's sole discretion, will coordinate with the Customer the completion/replacement/return of the product(s) and/or the Customer's charge/credit, as applicable and as required by law. It is hereby clarified that any completion and/or replacement and/or product return as stated above will require the Customer to pay additional shipping fees, in accordance with these terms.

Order Cancellation / Modification

  1. A Customer may cancel and/or modify an order until payment is made with a Store representative as described.
  2. Order cancellation/modification can only be done by phone.
  3. It is emphasized that the Customer's right to return a product and the Customer's right to cancel a purchase will be solely in accordance with and subject to the provisions of law, including the Consumer Protection Law 1981, the Sales Law 1968, and the Debit Cards Law 1986, and subject to Store policy as it may be from time to time.
  4. The Store may cancel an order provided it notifies the Customer two hours or more before the delivery date.

Liability

  1. The Customer will bear full responsibility for any damage and/or loss of any kind caused to them and/or the Store and/or any third party due to errors made in data entry, including errors in entering the delivery address, etc.
  2. The Customer releases the Store from any liability for damage of any kind that may be caused to them and/or any third party as a result of technical failures in hardware and/or software related to the Website.
  3. The Store will not be liable, in connection with the Website, for damage of any kind that may be caused to the Customer and/or any third party as a result of an act and/or omission beyond its control, including but not limited to - force majeure, such as: war, earthquake, extreme weather, etc.
  4. The Store will not be liable, in connection with the Website, for damage of any kind caused to the Customer and/or any third party as a result of communication failures (internet or phone) resulting from acts and/or omissions and/or negligence of internet providers and/or communication providers.
  5. Without derogating from all of the above, in any case the Store will not bear damages exceeding the price of products ordered and paid for by the Customer.

Website Security

  1. It is prohibited to perform or attempt to perform actions to disrupt the Website's operation, including but not limited to: unauthorized access to servers, accounts and/or data, testing, scanning, and/or sampling of the Website, including attempts to test its penetration, disruption and/or attempted disruption of service provided to Website customers and/or operation of the server(s) from which it operates.

Privacy Policy

  1. When making a purchase on the Website, the Customer will be required to enter personal information such as: full name, full address, ID number, address, email, and phone (hereinafter collectively: "the Information").
  2. The Store takes care not to transfer personally identifiable information about the Customer to third parties, except in one or more of the following cases:
  • Upon the Customer's request or explicit consent.
  • In case of a legal dispute between the Customer and the Store requiring disclosure of Customer details and/or if the Customer performs actions contrary to law on the Website and/or if a court order is received requiring such disclosure.
  • If it is found that the Customer has violated one or more of these service terms and/or in cases where the Customer performs or attempts to perform actions contrary to the terms of use or any law.
  • Pursuant to a court order or demand from a competent authority under law or to prevent commission of an offense.
  • In any case where the Store believes that disclosure of information is necessary to prevent serious damage to a person's property and/or body, or to prevent other serious damage at its sole discretion.
  • If the Store is sold, transfers and/or merges its operations with another entity, provided that the new information recipient accepts these terms of use in full.
  1. By joining the "Meshek Piltzovitch" online store services, the Customer confirms that information provided by them and/or about them will be collected and stored in the Store's databases for managing and improving the service and relationship with them, for operational, marketing, and statistical purposes, including information processing. The Customer knows that there is no legal obligation to provide the information and that provision is voluntary and with consent. Additionally, the Store may, for the purposes mentioned above, transfer information from time to time regarding purchases through the Website and/or Store to third parties at the Store's discretion.
  2. If the Customer wishes to be removed from the databases as described above, they must notify the Store in writing in accordance with the provisions of law.
  3. The Website is a secure site and Customer details entered will remain confidential and secure.
  4. It is clarified that performing actions on the internet website in an online environment does not provide the Store absolute immunity from intrusions into its computer systems and/or exposure of information in its possession by illegal actors. Therefore, if any third party succeeds in gaining unauthorized access to information stored by the Store and/or misusing it, the Customer will have no claim, lawsuit, and/or demand against the Store. Additionally, in cases arising from force majeure, the Store will not be liable for any damage and/or harm of any kind, direct and/or indirect, that may be caused to the Customer and/or anyone on their behalf, if any information provided by the Customer on the Website is lost and/or reaches any party who uses it without permission.

Store Rights on the Website

  1. The intellectual property on the Website, including copyrights and/or trademarks and/or designs and/or patents and similar rights on the Website, including Website design, software, applications, graphic files, texts, images, technologies, processes, content, icons, computer code, and any other material included on the Website ("Website Content"), are the full and exclusive property of the Store.
  2. The Store reserves all its rights and ownership in the Website Content, and entering the Website does not grant any license and/or right in the Website Content and/or any part thereof.
  3. The Store name and Website domain name, including all Store trademarks, are the full and exclusive property of the Store, and entering the Website does not grant any license and/or right in them.
  4. The Website and Website Content are intended for private, non-commercial use only, and their use is limited solely to the purposes of selling and buying products through them. It is prohibited to copy, duplicate, distribute, sell, and/or display material as detailed above.
  5. To the extent there are trademarks (including images, drawings, etc.) appearing on the Website belonging to other third parties, they are their property and no use may be made of them without their consent.

Applicable Law and Jurisdiction

  1. The engagement between the Customer and the Store through the Website and within the framework of these terms will be governed exclusively by Israeli law, and exclusive jurisdiction is vested in the courts.
